Dist. Judge C. Woodrow Laughlin, in a judgment entered in August, ruled that Valerio had won the commissioner's post in a write-in vote in the 1956 general election. After the commissioners court failed to seat Weatherly filed a motion in district court asking that the commissioners be declared in contempt of court. Laughlin dismissed the motion and Weatherly carried the contempt request to the Court of Civil Appeals.

Whether Valerio will be able to take office immediately under the appellate court's order remained a question this morning. Sidney P. Chandler, representing the commissioners court i in defense of the suit, said the commissioners would be able to purge themselves of the contempt by filing a. supersedeas bond suspending the district court judg. ment until final disposition of Ramos' appeal.

Chandler said the bond was being prepared this morning and would be filed as soon as Judge Laughlin set an amount. Ramos filed a supersedeas bond on his portion of the judgment shortly after Valerio made moves to have the judgment enforced. Weatherly has contended that Ramos' supersedeas bond came too late and that Valerio qualified for the office before the bond was filed. Any action taken before the bond was filed must stand, Weatherly has argued. It appears certain that Weatherly will again urge this stand if the commissioners court attempts to block the judgment again by filing a supersedeas bond.

"Unless we have assurance in writing within five days," the court opinion stated, "that respondents will carry out the judgment of the trial court, we will proceed to enter judgment holding respondents in contempt of this court." The penalty is a jail sentence, Weatherly said. Still pending in the Fourth Court of Civil Appeals is an argument on the merits of the Valerio case. Weatherly said the oral arguments probably will come up within a few weeks, but the ruling today obliges Duval commissioners to recognize Valerio until after the merits have been determined, or be held in contempt. In another action in the case this morning, the court turned down Weatherly's request to dismiss Ramos' appeal. Weatherly sought the dismissal on the grounds that the appeal was moot since Judge Laughlin had terminated Ramos' temporary district court appointment as 'commissioner.
